If someone asked you whether you’d prefer to pay a fine of £1 million, or, simply don’t break Health and Safety legislation – what would you pick? I know which one I’d rather.
There have been significant amount of sanctions and fines for breaching the Health and Safety at Work Act since the introduction of guidelines a year ago, medium-sized manufacturers have been warned of the significant fine risks that they may face on the first anniversary of the Health and Safety sentencing guidelines this month.
Many companies are being fined more than £1 million for non-fatal cases and in fact Health and Safety prosecutions for company directors and senior managers has rocketed over the past year, with the longest sentence being two years. The companies’ turnover is a huge factor of the size of the sentences. The sentencing guidelines for large organisations do not include sentencing tables, we are yet to see proportionate fines for the larger businesses who have a turnover of excess of £50m for example.
The truth of it is, as a company you are much better off spending your time and money upfront ensuring that you have your Health and Safety covered properly and following the rules rather than take that risk of not only having to pay the fines, but the risk of being prosecuted and the risk of fatalities.
