Health and safety fines have doubled since the introduction of the Corporate Manslaughter and Corporate Homicide Act 2007 in February 2016.
These fines have increased to £76.7 million, £36.2 million more than the previous year, with construction and manufacturing industries receiving the highest penalties.
Balfour Beatty were fined £2.6 million after an employee died when a trench collapsed on him and the chemical company Cristal Pigment were fined £3 million following two occasions where toxic gas clouds were released.
Under these tougher sentencing guidelines the size of fine is dependant on a company’s turnover and can be in excess of £20 million and even include imprisonment.
These unlimited fines are proportional to the size of your company:
Micro – Turnover not more than £2 million
Small – Turnover between £2 and £10 million
Medium – Turnover between £10 and £50 million
Large – Turnover over £50 million
As an example, a large company could face fines of up to £10 million for the most serious health and safety offences whilst corporate manslaughter fines could reach up to £20 million.
